Maharashtra Loose Oil Ban: CM Devendra Fadnavis Overrides FDA Order, Directs Regulator to Draft SOP

NEW DELHI / MUMBAI — In a major policy intervention aimed at balancing public health safety with small business interests, Maharashtra Chief Minister Devendra Fadnavis has stepped in to stall the Food and Drug Administration’s (FDA) blanket ban on the sale of loose edible oil.

The decision follows an August 20 directive by the Tukaram Mundhe-led food safety watchdog that strictly prohibited the open sale of edible fats and oils across the state. Under the CM’s fresh directives, the FDA must now formulate a balanced Standard Operating Procedure (SOP) to combat adulteration without causing widespread distress to traditional traders.

Ministers Raise Alarm Over Rural Impact and Small Business Threat

The FDA’s original order mandated that all edible oils and fats be sold exclusively in sealed, tamper-evident, and properly labeled food-grade packaging. The regulatory push was initiated to plug critical traceability gaps, address the reuse of non-food-grade containers, and curb the distribution of adulterated cooking oil.

However, the aggressive enforcement triggered strong pushback from regional trade bodies. Business owners argued that a total prohibition threatened long-standing, family-run establishments that rely heavily on unpackaged inventory.

The issue escalated during Monday’s Cabinet meeting, where several state ministers voiced concern over the immediate fallout on small vendors and consumers—particularly in rural markets where pre-packaged cooking oil remains scarce and unaffordable for many households.

CM Calls for a ‘Middle Path’ to Curb Adulteration

Addressing reporters following the Cabinet session, Chief Minister Fadnavis clarified that while consumer safety remains non-negotiable, regulatory measures must not jeopardize traditional livelihoods.

“We will direct the FDA to find a middle path by formulating an SOP that ensures the quality of edible oil and prevents adulteration, while also allowing traditional businesses to continue. The objective is to ensure that loose oil is free from adulteration without forcing these businesses to shut down,” Fadnavis stated.

The upcoming SOP is expected to establish clear guidelines on quality verification, hygiene protocols, and container safety standards to protect consumer health while maintaining economic stability for small sellers.
